Lawmaker’s Detention Upheld Amidst Bribery Allegations
An independent lawmaker, Kang Sun-woo, who is currently detained on charges of allegedly receiving 100 million Korean won (approximately $75,000 USD) in exchange for nominating a former Seoul city council member, has had his request to revoke his detention denied by the court. The ruling comes nearly three weeks after Kang was initially detained by police on charges related to violating the Political Funds Act.
The legal community reported on the 26th that the Criminal Division 5-2 of the Seoul Central District Court, presided over by Judge Kim Yong-jung, dismissed Kang’s plea after a hearing on the necessity of his continued detention. The allegations against Kang stem from his position as the head of the Democratic Party’s Gangseo Gap district committee in January 2022. He is accused of accepting a substantial sum of 100 million Korean won in cash from Kim Kyung, a former Seoul city council member. This alleged exchange was reportedly accompanied by a request for Kang to facilitate Kim’s nomination as a candidate for the Seoul city council. The alleged meeting and transaction took place at the Hyatt Hotel in Yongsan-gu, Seoul. Significantly, Kim Kyung was subsequently elected as the Democratic Party’s sole nominee for the city council position in the first electoral district of Gangseo-gu during the nationwide local elections held in June 2022, just five months after the alleged bribe.
Legal Proceedings and Charges
The police have levied serious charges against both individuals involved. Kang faces accusations of violating the Political Funds Act, the Improper Solicitation Prohibition Act, and charges of breach of trust and bribery. Kim Kyung, on the other hand, is charged with offering bribery. Following their initial investigations, the police applied for arrest warrants for both Kang and Kim on the 5th of the previous month. The prosecution subsequently requested arrest warrants from the court four days later. The court ultimately ordered the detention of both Kang and Kim on the 3rd, citing a significant “concern about destruction of evidence” as the primary justification for their continued confinement.
